NYC Construction Executives’ Sentences Reduced
Two construction executives of Testwell Laboratories, Inc., who had been sentenced to significant prison sentences for conducting fake safety tests on steel and concrete in projects throughout the New York City area, recently saw their sentences dramatically reduced by a state appellate court.
CEO V. Reddy Kancharla and Vice President Vincent Barone had been sentenced to 7-21 years and 5 1/3-16 years, respectively, as a result of allegations that they had submitted fake test results at more than 120 different construction sites over a multi-year period. However, the appellate court overturned the most serious charge, criminal enterprise, and reduced both men’s sentences to 16 months-4 years, citing lack of evidence in the decision.
While the court’s judgment should be respected, it’s important to note how serious these types of crimes can be. When critical safety tests are ignored or falsified, it can place both employees working on a construction project and all those who may use the structure in the future in serious danger of suffering a devastating injury.
